A patient with a long history of mental illness struck a 57-year-old patient in the head several times during an argument and fight in the common area of a hospital's psychiatric unit. A subdural hematoma and brain injury resulted that requires the injured man to live in an assisted living center for the rest of his life. The hospital, sued under a theory of medical malpractice and premises liability, purchased an annuity which will pay more than $2.4 million in benefits for the man's care.
