We were lead counsel representing the guardian of a 47-year-old woman who developed extensive bleeding and clotting and digestive tract trauma following gastric bypass surgery. One of the two original surgeons removed the blood clots in a follow-up procedure. When problems reappeared, a second follow-up procedure was needed, and the patient remained in intensive care for four weeks — after which she suffered acute kidney dysfunction, hyperkalemia and cardiac arrest. The result was a brain injury and significant weakness in both legs that rendered her wheelchair-bound. After the deposition of our experts in the case, the hospital agreed to a $5 million settlement approved by Cook County Court, although the case against the surgeons is still pending.
